Cancellation policy
1. General
Once on board the client must recognize and accept the maritime rules and laws. Likewise, you must accept the highest authority of the boat's master.
2. Responsibility
Unfavorable weather conditions, maritime accidents or circumstances that may endanger the safety of passengers and the ship may cause changes to the travel destinations and ports of embarkation or disembarkation. Likewise, they can be the cause of the interruption of the trip, the carrying out of repairs, returning ahead of schedule, postponing the trip until the appropriate time to sail to port, or the interruption of sailing itself. These changes will be exclusively adopted by the Employer.
In any of these cases, which are considered force majeure, as a general rule, reimbursement of costs by the organizer or withholding of payments by the client will not be possible.
3. Insurance
The boat has its Civil Liability and SOVI (Compulsory Travel Insurance) insurance policies.
The skipper is not responsible for loss or damage to objects of his property that passengers carry with them.
4. Payment terms
The contract must be signed by the client and sent to Proyectos Navales del Sur SL within 5 calendar days after the date of its issuance, and the client must make the first payment, consisting of 50%, to the account indicated in the document. annex, at the time of signing the contract. Once the first payment has been received, the contract will be valid for all purposes, considering the boat reserved for the client.
Payment of the total amount of the invoice must be made in the following way: First payment 50% upon signing the contract and the second payment of the remaining 50% maximum ten days before the event.
In the event that the client refuses to make one of the payments without justified cause according to this contract, the shipowner will have the right to make the reserved boat available to another person on the dates initially reserved by the client. In this case, payments already made will not be refundable.
5. Service failure
The client will immediately communicate any possible failure in the service to the organizing company in order to solve the problem. Service failures reported after the event will not be considered.
6. Cancellation Policy
6.1.) In the event that the cancellation occurs due to adverse weather conditions, a decision made by the skipper of the boat, the date may be changed at no cost to the client.
6.2) In the event that the cancellation of the departure occurs unilaterally by the client, the cancellation costs will depend on the advance notice with which it is communicated:
a) Up to 10 days before the event, cancellation costs will be 25% of the first payment
b) Subsequently, the cancellation costs will be 100% of the event price.
It is strictly prohibited to carry any type of weapons on board and consume drugs.
7. Jurisdiction
Both contracting parties, waiving their own jurisdiction if they have any, expressly and manifestly submit to the judges and courts of the city of CADIZ, to resolve any issue arising from the interpretation and execution of this contract.
